Buyer has paid a deposit of $200, with payment of the balance of $1,800 due upon delivery. The expected delivery date is February 19, 2023, or such other date as the parties may mutually agree.
Buyer acknowledges and agrees that Buyer will forfeit the deposit and any rights to the Dog if:
A) Buyer fails to complete the purchase of the dog/puppy for any reason, or
B) Buyer fails to pay the balance of the purchase price within 0 days of the agreed delivery date. If either of the two (2) aforesaid evens occur, Seller shall be free to sell the puppy/dog to another party.
In the even that the dog is not available due to sickness, death, or any other circumstance due to the fault of Seller, Buyer’s deposit will, at Buyer’s option, be either (i)
refunded, or (ii) transferred to the next litter of puppies.
A boarding fee of $20 per day will be charged for each day the dog/puppy is boarded by Seller part the agreed delivery date.
Seller represents and warrants to Buyer that:
a) Seller is the true and legal owner of the Dog and that Seller has full legal rights and authority to sell the dog/puppy.
b) The Dog/Puppy is being sold free and clear of any lien, security interest, charge or other encumbrance.
c) The Dog/Puppy is in good health, and free of communicable diseases at the time of this sale and seller has conducted a health check prior to delivery of the Dog and has followed deworming (weeks 2, 4, 6, and 8) and vaccination protocols as outlined by Dr. Karl Yorko’s vaccination protocols.
d) Notwithstanding any statutory, ordinance or legal provisions to the contract Buyer has two (2) business days (48 hours) from the delivery date to have the Dog/puppy examined by a licensed veterinarian, at Buyer’s sole cost. Buyer agrees to not subject the Dog/Puppy to a SNAP Parvo test and acknowledges that a SNAP Parvo test is inaccurate and unreliable as an indicator of Parvo.
e) If the puppy has a genetic defect detected by a licensed veterinarian within one year (guarantee ends when pup turns one year old) a full refund will be made or another dog of equal value, the choice to be determined by the seller. Buyer must return the puppy (at buyer’s expense) within a month of the exam that detected the defect before replacement will be made. Seller must also have a letter from the veterinarian with his address, telephone number, and the defect detected before any replacement puppy is given. If the buyer refused to return this puppy for a replacement puppy, then this guarantee is null and void.
f) Should the dog/puppy die from communicable diseases (this does not include parasites or hypoglycemia) within 10 days of purchase and buyer promptly sought treatment by a certified veterinarian, and if said vet certifies that the puppy was thought to have been exposed to the disease prior to leaving sellers home, buyer will get full refund of purchase of puppy/dog within 45 days of certification of death (or autopsy report, whichever comes last). Any refund will never be in excess of original price. Buyer must send certification 2 of 3
(autopsy required only if vet is unsure of actual cause of death) to seller within 6 weeks of pups death.
g) Seller cannot guarantee the puppy’s size, color, or temperament after the puppy leaves our home.
h) Buyer releases seller from any and all liabilities and/or damages by fault of this dog/puppy after the time of sale. These damages include, but are not limited to destruction of property and/or physical damage to any person or group of people.
i) Seller is not responsible for any veterinarian bills or any other bills once the puppy leaves our home
The dog/puppy was bred as a companion animal, and seller does not provide any warranty as to the dog’s fitness for any specific or particular purpose, including but not limited to obedience trials, show ring performance, and/or breeding purposes.
Buyer represents to seller that:
A) Buyer will provide the dog/puppy with nutritious food and necessary veterinarian care, eluding deworming, heart worm prevention, and regular vaccinations (including rabies).
B) Buyer warrants and represents that she/he are not acting as the agent or representative of, or in any way on behalf of, any other person, business, organization or entity in the purchase of the dog/puppy.
C) Buyer certifies that she/he is not a paid worker, member or volunteer of has any connection to any animal rights groups such as, but not limited to, the Humane Society of the United States (HSUS), American Society for the Prevention of Cruelty to Animals (ASPCA), Society for the Prevention of Cruelty to Animals (SPCA), People for the Ethical Treatment of Animals (PETA), or any such similar organization (on either a national, state, or local level).
D) Your dog/puppy comes with up to date vaccinations, and Buyer should not have the dog vaccinated within the first two (10) days of receiving the Dog/puppy in order to avoid over-vaccination.
